The terms governing our supply of solar, battery, and electrical services.
1. About These Terms
These Terms and Conditions ("Terms") govern the supply of solar, battery storage, EV charging, electrical, and related services ("Services") by Solar Plus Electrical Pty Ltd ("Solar Plus Electrical", "we", "us", or "our") to you ("Customer" or "you").
By accepting a written quote or engaging our Services, you agree to be bound by these Terms. Please read them carefully before proceeding.
2. Quotes and Acceptance
All quotes are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. A quote does not constitute a contract until accepted in writing (including by email) by you and confirmed by us.
Quotes are based on information available at the time of assessment. If site conditions differ materially from those assessed (e.g. undisclosed asbestos, non-standard roof structures, or network constraints), we reserve the right to revise the quoted price before commencing work.
3. Payment Terms
Unless otherwise agreed in writing:
- A deposit of 20% of the total contract price is payable upon acceptance of the quote.
- The balance is due on the day of installation completion.
- Payments are accepted by bank transfer, credit card, or other methods as agreed.
Overdue amounts accrue interest at 10% per annum calculated daily from the due date. We reserve the right to suspend or withhold Services where payment is overdue.
4. Government Rebates and Incentives
Where applicable, we will assist you in claiming government rebates and incentives, including Small-scale Technology Certificates (STCs) under the Small-scale Renewable Energy Scheme. The rebate amount is applied as a discount to your invoice.
The availability and value of rebates are subject to change by government policy and are not guaranteed. Any change to rebate values after quote acceptance but before installation will be communicated to you in writing and may result in a price adjustment.
5. Installation
We will carry out all installations in accordance with applicable Australian Standards, the relevant state and territory electrical safety legislation, and the Clean Energy Council's installation guidelines.
You are responsible for:
- Providing safe, unobstructed access to the installation site including the roof and switchboard area.
- Ensuring the property is suitable for the agreed system design (e.g. adequate roof space and structural integrity).
- Obtaining any strata, council, or heritage approvals required prior to installation.
We will make every reasonable effort to complete installation on the scheduled date. We are not liable for delays caused by events outside our control, including adverse weather, network distributor delays, or supply chain issues.
6. Variations
Any variation to the agreed scope of work must be confirmed in writing by both parties. Additional charges may apply. Work will not commence on variations until a written variation order has been accepted.
7. Warranties
The following warranties apply to our Services:
- Workmanship warranty: 10 years on all installation work carried out by our licensed electricians.
- Product warranties: All products (panels, inverters, batteries, and accessories) carry the manufacturer's warranty as specified in your quote. These are typically 10–12 year product warranties and 25–30 year performance guarantees for Tier 1 panels, and 5–10 years for inverters.
Warranties are void if the system is modified, damaged, or serviced by an unlicensed party. Our workmanship warranty does not cover damage caused by events outside our control including storms, floods, fire, or impact damage.
Our Services come with consumer guarantees under the Australian Consumer Law that cannot be excluded. These Terms do not limit any rights you have under Australian Consumer Law.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability to you in connection with the Services is limited to the amount you have paid us for the specific Services giving rise to the claim.
We are not liable for indirect, consequential, or special loss or damage (including loss of revenue, profit, or opportunity) arising from the supply or failure of our Services.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
9. Energy Generation Estimates
Any estimated energy generation, savings, or payback periods provided in a quote or assessment are indicative only. Actual results will vary depending on weather conditions, shading, system orientation, changes to electricity tariffs, and actual consumption patterns. We make no guarantee as to actual energy generation or financial savings.
10. Cancellation
You may cancel your order in writing before the scheduled installation date. The following cancellation terms apply:
- Cancellation more than 14 days before installation: deposit refunded less any reasonable costs incurred (e.g. design fees, equipment ordered to specification).
- Cancellation within 14 days of installation: deposit is non-refundable. Where equipment has been ordered, you may be liable for the cost of that equipment.
We reserve the right to cancel a contract where installation is impractical due to unforeseen site conditions, in which case any deposit paid will be refunded in full.
11. Dispute Resolution
In the event of a dispute, you agree to notify us in writing and allow us 14 days to resolve the matter before escalating to any external body. If the dispute is not resolved, either party may refer the matter to the relevant state or territory consumer protection authority or tribunal.
12. Privacy
We handle your personal information in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
14. Entire Agreement
These Terms, together with the accepted quote, form the entire agreement between you and Solar Plus Electrical in relation to the Services and supersede all prior representations, negotiations, or agreements.
